Welcome to the Mikelle Consulting e-learning platform. By registering an account or purchasing an online course from Mikelle Consulting (PTY) LTD (“Mikelle Consulting”, “we”, “us” or “our”), you (“the student” or “user”) agree to the following terms and conditions. Please read these Terms and Conditions (“Terms”) carefully before using our website and online courses. These Terms are designed to protect our content and outline the rules for participation in our courses.

1. Course Access and Accounts

Single User License: Course purchases are for individual use only. When you enroll in a course, you are granted a single-user license to access the content. You may not share your account login credentials or course materials with others. Each person who wishes to take a course must register and purchase access separately.

Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. If we detect account sharing or suspect unauthorized use, we reserve the right to suspend or terminate the account without refund. Please notify us immediately of any breach of security or unauthorized use of your account.

2. Use of Course Content and DRM Protection

All online course videos, documents, and materials are protected by Digital Rights Management (DRM) and other security measures. Authorized Use: As an enrolled student, you have a personal, non-transferable right to view the content for your own learning. You may not download, reproduce, distribute, or publicly display any course content without our explicit permission. This includes recording videos, screen-capturing lessons, sharing files, or any attempt to circumvent DRM protections.

Prohibited Actions: Any attempt to copy, share, or hack our course content is strictly forbidden and may result in immediate termination of your access. We actively monitor usage and will enforce our rights to protect our intellectual property. If your access is terminated due to a violation of these terms, you will not be entitled to any refund or compensation. We also reserve the right to take legal action in cases of content theft or piracy.

3. Payments and Refund Policy

Payment Processing: All course fees are payable in advance. Payments are processed securely via PayFast, our chosen payment gateway. PayFast is a trusted third-party service that encrypts your financial information; we do not store any credit card details on our servers. Course prices are listed in South African Rand (ZAR) and include VAT (Value Added Tax) where applicable. By purchasing a course, you authorize us (through PayFast) to charge the specified amount to your payment method.

Refunds: Due to the digital nature of our products, all sales are generally final. We do not automatically offer refunds for course purchases once access has been granted. If you experience technical difficulties that prevent you from accessing the content, or if you believe there are extenuating circumstances, please contact us within 7 days of purchase to request assistance. Refund requests will be evaluated on a case-by-case basis at our sole discretion. We reserve the right to issue or refuse refunds as deemed appropriate.

Failed Payments: If a payment is declined or if a chargeback occurs, your course access may be suspended. Should you dispute a payment with your bank or credit provider, please inform us so we can resolve the issue promptly. Any bank fees or reversal charges incurred due to disputes may be passed on to the user.

4. Intellectual Property Rights

All content on our website and within our courses – including videos, slides, text, graphics, logos, and downloadable materials – is the intellectual property of Mikelle Consulting or our content providers. This content is protected by copyright, trademark, and other intellectual property laws. Ownership: Purchasing a course does not transfer any ownership rights to you. Instead, you receive a limited, revocable license to use the materials for personal educational purposes only.

You may not reuse, republish, or distribute any content from our courses or website without prior written consent from Mikelle Consulting. The “Mikelle Consulting” name and logo are our trademarks; you are not permitted to use them in any way that implies endorsement or partnership without our approval. Any unauthorized use of our intellectual property is a violation of these Terms and may also violate legal statutes.

5. Privacy and Data Protection

We value your privacy. When you register on our site or purchase a course, we collect certain personal information (such as your name, email, and contact details) to manage your account and course progress. All personal data is handled in accordance with applicable data protection laws. We use your information only for internal purposes: providing course access, tracking your progress, issuing certificates, and communicating with you about your enrollment. We will not sell or share your personal information with third parties for marketing purposes.

Our payment processor, PayFast, will collect your payment details securely. Mikelle Consulting does not store your credit card information. By using our site, you also agree to our Privacy Policy (if available on a separate page) which provides more detail on how we handle data. We may use cookies or similar technologies to enhance your user experience on our website, and by using the site you consent to this.

If you participate in any course discussion forums or comment sections (if enabled), please note that any information you share there becomes visible to others in the course. Please exercise discretion when sharing personal information in interactive areas.

6. Disclaimers and Limitation of Liability

Educational Purpose: Our online courses and materials are provided for educational and training purposes. While we strive to ensure accuracy and quality, Mikelle Consulting makes no guarantee that completing a course will result in specific outcomes or certifications beyond our own certificate of completion. Always apply professional judgment and comply with all applicable laws and regulations in your workplace when implementing knowledge from our courses.

No Professional Advice: The content of the courses does not constitute legal, engineering, or professional advice specific to your situation. For personalized advice, you should consult a qualified professional or engage our consulting services directly.

Use at Your Own Risk: You agree that you participate in our courses and apply the information at your own risk. To the extent permitted by law, Mikelle Consulting, its directors, and instructors shall not be liable for any direct, indirect, incidental, or consequential loss, injury, or damage to persons or property arising from or related to your use of our course materials or website. Technical Availability: We strive to keep the e-learning platform available 24/7, but we do not guarantee uninterrupted access. Downtime may occur for maintenance or due to technical issues. Mikelle Consulting is not liable for any inconvenience or data loss that may result from temporary service outages. However, we will do our best to support students and restore access as quickly as possible in the event of disruptions.

7. User Conduct and Acceptable Use

When engaging with our website or courses, you agree to behave respectfully and lawfully. This means you will not post offensive, harassing, or illegal material in any course interactions (e.g., Q&A sections or forums, if provided). You will not attempt to introduce malicious code or do anything that compromises the security of our site. We reserve the right to remove any user-generated content that violates these standards and to take appropriate action against the accounts involved.

8. Modifications to Courses or Terms

Mikelle Consulting reserves the right to update course content or these Terms & Conditions at any time. If course material is updated (for example, to reflect new regulations or improved modules), enrolled students will typically retain access to the updated content at no extra charge for the duration of their access period. We may also make changes to these Terms as needed to comply with laws or improve our policies.

Notification of Changes: We will post any revisions to the Terms on this page with a new “Last Updated” date. It is the user’s responsibility to review the Terms periodically. Continued use of the website or courses after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue using the platform.

9. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa. By using our services, you submit to the jurisdiction of the courts of South Africa for any disputes that may arise. If any provision of these Terms is found to be unenforceable under South African law, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions.
